Definitions

Advert:

The whole design including details and space for elements (visual, text, sound, photographs, drawings) provided to the advert buyer who is the exclusively responsible for the content, to be displayed on the French Property Marketplace website, to be seen by the potential purchaser.

Advert buyer:

A physical person, over 18, who is acting exclusively in a private, non-professional capacity to sell or let the property they own, or who is authorised to assist such a person and are holders of a personal account.

A registered business providing services in one of the following categories:

Estate agency services.

Legal and translation services related to real property.

Financial services related to real property.

Removal services related to real property.

Photographic, video and virtual services related to real property.

All advert buyers will be connected to their French Property Marketplace personal account to submit real estate property adverts. The creation of a first advert will be preceded by an account creation.

Personal Account:

The space which an advert buyer must create on frenchpropertymarketplace.com.  To subscribe to one or more package and to manage and see their adverts, the advert buyer must be connected to this French Property Marketplace personal account.

Partner Account:

The space created by French Property Marketplace on frenchpropertymarketplace.com for partner advert-buyers. Partner adverts are managed by French Property Marketplace for the partner based on an individual contract with each partner with separate partner terms and conditions. Where a partner account no longer meets the partner terms and conditions, the partner account will revert to being a personal account and this terms and conditions document will apply.

The French Property Marketplace service:

All the services provided by French Property Marketplace to their Internet Site users are according to the French Property Marketplace General Terms of Use.

Internet Site:

The Internet site provided by French Property Marketplace is accessed via the link https://frenchpropertymarketplace.com and providing access to users and according to General Terms of Use.

User:

Any visitor having access to the service French Property Marketplace via the Internet Site and consulting the service French Property Marketplace via any alternative support services.

Package:

A single advert or multiple adverts proposition to purchase.

Purpose

These Terms and Conditions of Sale (TCS) establish contractual conditions when an advert buyer is connected to their personal account, and they purchase advertising on the Internet Site.

Acceptance

Subscription to free or payable packages by an advert buyer is clear and total acceptance of the TCS.

Subscription Packages

The subscription to one or more packages is exclusively accessible to advert buyers connected to their personal account in the Internet Site.

A subscription package provides the number of adverts specified in the package and as such is not transferable to the benefit of another package.

It is not possible to subscribe simultaneously to different packages.

The price, duration and included services of each package is displayed in the package description detailed on the Internet Site.

 Adverts are sorted on the Internet Site in chronological order based on the date and time submitted. As a result, all advert buyers understand that the presence at the top of the list is temporary. 

The subscription packages are active once payment has been confirmed.

When the advert is taken down (either by the advert buyer, by the French Property Marketplace where there is abusive content, or on the expiry of the period of publication), the subscription ceases. The reinstatement of the advert does not extend the duration of the subscription.

The modification of any item will not prolong the duration of the advert, or any options associated with it.

The removal of an account will bring the deletion of all adverts associated with it. The advert buyer understands and accepts that in these circumstances, the payments made will not be refundable or indemnified.

Description of the packages and Non-Payable Services

Small Agency and Private Advert-Buyers’ Packages:

The advert(s) will be created by the advert buyer on the Internet Site, and the content will be according to the package purchased. An email will be sent to the advert buyer to confirm the purchase of the package, and a further email will be sent within two working days of the submission of each advert, approving the advert and advising of its publication. An email will also be sent advising of any non-approval or the advert expiry.

French Property Marketplace reserves the right to delete any advert / item which does not respect the Property Advert Publication Rules . Where a publication of an advert is refused, the advert buyer will be notified by email.

Property Professional (Agency) Packages:

The advert(s) will be created by the advert buyer via an automated feed from their agency-held data to the Internet Site, and the number of adverts and content will be according to the package purchased. An email will be sent to the advert buyer to confirm the purchase of the package, and a further email will be sent detailing the property feed processes.

Non-payable services:

Featured Advert – an advert for a property over 200.000€ will be temporarily displayed on the home page of the Internet Site and will be searchable on the Internet Site.

The advert buyer is permitted to modify all fields in their account and on their real estate property advert(s) to render them accurate. All modifications will be reviewed by the French Property Marketplace.

It is the duty of the advert buyer to verify the content of the account and of the advert. Despite this, French Property Marketplace reserves the right to delete any modified advert / item which does not respect the Publication Rules. Where a modification is refused, the advert buyer will be notified by email.

Package Price

The prices applied are those in force at the time of the purchase of the package.

Payments and Billing

The purchase of a subscription is made by an advert buyer connected to their personal account by:

Their PayPal account accessed through the Internet Site or

By Credit or debit card via PayPal’s guest service, accessed through the Internet Site.

Payment is demanded prior to the submission of the advert.

All purchases of subscription packages will create an invoice accessed through the advert buyer’s account. An email will be sent following each purchase.

Refunds and Retraction

Refunds:

Paid for packages are not refundable.

If the publication of the advert has been refused by French Property Marketplace, due to it not conforming to the Publication Rules, and the advert buyer decides not to submit further adverts, a claim by the advert buyer for a refund will be considered on a case-by-case basis.

If French Property Marketplace is forced to delete an advert because of its non-conformity to the Publication Rules because the content is confirmed as being abusive, French Property Marketplace will not refund the advert buyer all or part of the amount paid for the package and an email will be sent to the advert buyer advising them that the advert creation has been refused.

If the modification of the advert has been refused, due to it not conforming to the Publication Rules, French Property Marketplace will not refund the advert buyer all or part of the amount paid for the package and an email will be sent to the advert buyer advising them that the advert modification has been refused, and that the advert will be withdrawn from publication.

The advert buyer understands and accepts that, where a personal account has had to be deleted and, as a result, all the attached adverts, this will not give the right to a refund or indemnity.

Retraction

By application of the article L121-21 of the Code de la Consommation, the advert buyer has 14 days to withdraw from a purchase. This is done by contacting French Property Marketplace and all services made available will be deleted and a full refund will be issued.

Modification of the TCS

French Property Marketplace reserves the right to totally or partially change the TCS.

Advert buyers are invited to regularly consult the TCS and make themselves aware of the changed content.

Miscellaneous Provisions

If any part of the TCS has been found to be illegal, invalid or inapplicable for whatever reason, the provisions will be deemed to have not been written without invalidating the other provisions which continue to apply between the Advert buyer and French Property Marketplace, except if it is a clause which has caused one of the parties to purchase a payable service.

All claims and grievances should be addressed to French Property Marketplace using the Contact Us link on the Internet Site.

The TCS are subject to French law.
